Frequently asked questions
The answers are general. Specific legal advice is only possible after reviewing the circumstances and documents of your case.
Yes. Consultations, correspondence and explanations of documents are available in English and Serbian. Submissions to Serbian courts and authorities are made in Serbian, so documents in another language usually need a translation by a Serbian court interpreter (sudski tumač).
Yes. Most of the communication can take place by phone and email. Where you cannot be present in person, the lawyer can act on your behalf on the basis of a power of attorney (punomoćje).
A power of attorney signed abroad usually has to be certified, either at a Serbian embassy or consulate, or by a notary in your country with an apostille, and then translated into Serbian by a court interpreter. The exact wording depends on what the power of attorney is for, so it is best to agree on it before you sign.
Yes, after prior agreement. For some steps the original documents are needed, and you will be told about this in good time.
In general, foreign citizens can acquire real estate in Serbia subject to reciprocity between Serbia and their country, while special rules apply to agricultural land. Whether and how this applies in your case is checked at the start. More on this: buying real estate in Serbia.
Yes. Living abroad does not prevent you from inheriting, and foreign citizens inherit on the same terms as Serbian citizens, subject to reciprocity. The probate proceedings (ostavinski postupak) take place in Serbia, and you can take part in them through a lawyer with a power of attorney. More on this: inheritance in Serbia for heirs abroad.
It helps to have everything related to the matter: contracts, decisions, extracts from public registers, correspondence, summonses and submissions. If you are not sure what is relevant, bring what you have, in whatever language it is. The first conversation establishes what else needs to be obtained and what needs to be translated.
The first conversation is used to get to know the circumstances of the case and to review the available documents. After that, your legal position is assessed and the possible courses of action are explained, with clearly stated next steps. The outcome of a case is never promised.
The transfer takes place in two steps. First, a contract (of sale, gift, exchange or on another basis) is concluded in writing and certified by a public notary (javni beležnik). The ownership right is then registered in the Real Estate Cadastre on the basis of that contract; until registration, the acquirer is not yet the owner in the legal sense. Before signing, it is worth checking the cadastre records: who is registered as the owner and whether the property is subject to encumbrances, mortgages or annotations.
